Description
The civil and criminal liability of employers and managers under OSHA’s current enforcement agendas will be discussed, covering such issues as enhanced penalty policy, repeat citation policy expansion, severe violators enforcement policy, recordkeeping enforcement policy and native language enforcement policy. It will also cover the expansion of the General Duty Clause, touching on the subjects of heat illness, workplace violence, combustible dust and ergonomics. Finally, what to expect and how to handle an OSHA inspection, including employee interviews, rights of employers, employees and OSHA, the expansion of the definition of Supervisor by OSHA to reduce burden to prove citations, and how to respond to an OSHA fatality or catastrophe inspection will be discussed.

Mark is a Labor and Employment Attorney and Partner with Seyfarth Shaw. He specializes in Occupational Safety and Health Law and related employment law and personal injury litigation. He graduated from the University of Notre Dame in 1968 and DePaul University School of Law in 1974. He was a Commissioned Officer in the U.S. Navy and is a Vietnam Veteran.
